Farmers Insurance settles TCPA calls case for $2.9 mn

Farmers Insurance agreed to pay $2.87 mn to settle claims that it violated the federal Telephone Consumer Protection Act through unsolicited telemarketing calls and text messages.

The settlement covers consumers who received at least two calls or texts during a 12-month period from Todd Henderson Insurance Agency Inc. or R. Todd Henderson.

Their personal phone number must have appeared on the National Do Not Call Registry for more than 30 days, according to Beinsure.

Farmers sells insurance policies for homes, vehicles, businesses and other property through a network of independent agents.

The class action alleged that Farmers agents made repeated marketing calls and sent texts without consumer consent. Plaintiffs said they had not requested these communications and suffered harm through the unwanted outreach.

Farmers did not admit liability under the agreement. The insurer agreed to resolve the case through the $2.87 mn settlement fund.

Eligible class members may receive a cash payment. The final amount will depend on the number of valid claims, although settlement materials estimate payments of up to $425 per person.

To qualify, consumers must have received two or more Farmers marketing calls or texts between October 8, 2020, and March 13, 2026. The communications must have come from Todd Henderson Insurance Agency Inc. or R. Todd Henderson.

Claimants must also confirm that they did not request a Farmers insurance quote before the contact. They must not have been Farmers customers when the calls or texts arrived, or during the preceding 18 months.

The deadline to opt out of the settlement or file an objection is July 7, 2026. Eligible consumers must submit a valid claim form by July 24, 2026.

A final approval hearing is scheduled for July 31, 2026. According to Beinsure, the settlement focuses on alleged breaches of do-not-call protections rather than claims tied to policy sales or insurance coverage.
