Vermont drops sexual assault charges against former AIG executive David McElroy

Authorities in Vermont have dismissed sexual assault charges against David McElroy, a former senior executive at American International Group.

According to a filing in Vermont Superior Court in Lamoille County, the state’s attorney moved on Dec. 31, 2025 to dismiss the case without prejudice.

The filing cited the complaining witness’s ongoing trauma, which prosecutors said prevents preventing full participation in the criminal process at this time.

A dismissal without prejudice leaves prosecutors free to refile the case later.

McElroy’s attorney, David V. Kirby, confirmed the dismissal and declined further comment. He has previously said McElroy categorically denied all allegations.

McElroy, who most recently served as chairman of AIG’s General Insurance business, was charged in late 2024 with three counts of sexual assault and one count of lewd and lascivious conduct.

The allegations stemmed from an evening in early March 2024 involving a woman who attended a client conference and fundraiser at the Lodge at Spruce Peak resort in Stowe, Vermont.

McElroy told police he believed the encounter was consensual.

Shortly after speaking with authorities, AIG announced McElroy would retire effective May 1, 2024. The company said at the time that the 66-year-old executive agreed to accelerate his retirement for personal reasons and would remain available to the firm.

As of Jan. 1, McElroy had been serving as chairman of General Insurance, with responsibilities focused on client development, distribution partner relationships, and support for underwriting discipline.

McElroy joined AIG in October 2018 as president and CEO of Lexington Insurance, the company’s surplus lines unit. He was promoted to president and CEO of North America General Insurance in June 2019 and became CEO of General Insurance in August 2020.

AIG chairman and CEO Peter Zaffino previously said McElroy joined the company during a critical period, as AIG worked through a multi-year effort to strengthen underwriting performance and refine its risk appetite.
