The rise of “silent AI” is pushing insurers to adjust policy wordings, redesign products, trim uncomfortable exposures and reassess their reinsurance protections, according to DAC Beachcroft.
Silent AI covers risks tied to artificial intelligence that aren’t explicitly included or excluded in a policy, leaving space for messy coverage disputes if something goes wrong.
The firm said policy language keeps evolving as AI becomes a routine part of business operations. Buyers and brokers want clearer answers about whether their programmes capture AI-linked losses, and many are pressing for wordings that spell out what is and isn’t covered.
According to Beinsure analysts, that pressure has been building for years, but the shift toward agentic systems is speeding things up.
DAC Beachcroft expects silent AI to drive even more product innovation in 2026, alongside insurers trying to limit or condition exposures they see as too volatile.
The firm said policyholders should check for AI-specific exclusions, keep their own AI use ethical and well-governed, and understand how insurers deploy AI in underwriting, pricing and claims.
The firm also flagged that insurers will increasingly test the strength of their outward reinsurance protections. If primary policies affirm certain AI risks, carriers will want confirmation that their reinsurers back those exposures.
Reinsurers may apply their own conditions or exclusions, which could shape how claims are adjusted when AI is involved.
DAC Beachcroft stressed that agentic AI poses heightened data protection issues. These autonomous systems act with reduced oversight and rely heavily on personal and sensitive data.
Many organisations struggled to govern generative AI; agentic models raise the stakes. Less human control means mistakes or misuse can balloon faster, especially where special-category data is involved.
The firm also warned insurers to watch for AI-generated fraud.
Claims that once looked like clean evidence of loss now hide fabricated photos, synthetic commercial invoices or digitally altered statements. It’s cropping up in personal lines and commercial lines alike.
DAC Beachcroft expects this kind of fraud to accelerate in 2026, pushing insurers to scrutinise evidence even from polished, reputable businesses.
On top of all that, regulation lags behind. Existing frameworks weren’t built for self-learning systems or generative models.
Accountability, transparency and bias controls don’t map neatly onto AI that rewrites its own behaviour. That gap leaves insurers juggling risk, ethics and compliance with fewer guardrails than they’d like.
